1. Role of Beauty Charters

Beauty Charters primarily acts as an intermediary connecting customers with charter companies offering boating excursions departing from Saint-Martin and the surrounding area.

Beauty Charters facilitates the search for a boat, communication with the service provider, and the organization of the booking.

Unless otherwise stated, Beauty Charters is not the owner, operator, or skipper of the selected boat and does not directly provide navigation services.

2. Contract with the Charter Company

The contract governing the rental of the boat and the performance of the excursion is the contract entered into with the charter company operating the selected boat.

This contract and the charter company’s rental terms determine, in particular, the rules relating to pricing, payment, cancellation, security deposits, damages, insurance, weather conditions, and the conduct of the excursion.

If the customer wishes, they may ask Beauty Charters to put them in contact with the charter company in order to obtain its rental terms before the excursion and, preferably, before paying the deposit.

3. Pricing, Booking and Payment

The price offered to the customer through Beauty Charters is the same as the price offered by the charter company for the relevant service. Using Beauty Charters therefore does not result in any additional cost to the customer.

Beauty Charters may receive a commission from the charter company for its introduction and booking organization services. This remuneration has no impact on the price paid by the customer.

A booking is confirmed in accordance with the terms communicated to the customer at the time of booking.

Beauty Charters generally collects the deposit required to confirm the booking as part of the reservation with the relevant charter company.

The balance may be collected in accordance with the terms indicated at the time of booking and/or directly by the charter company.

The amount of the deposit, the outstanding balance, and their respective payment deadlines are those stated in the quotation, booking confirmation, and the service provider’s terms and conditions.

4. Cancellation by the Customer

Cancellation terms are those provided by the selected charter company and communicated to the customer at the time of booking.

Depending on these terms, cancellation may result in the full or partial retention of the deposit or the application of cancellation fees.

Any cancellation request must be communicated as soon as possible to Beauty Charters and/or the relevant charter company.

5. Cancellation, Weather and Rescheduling

The charter company or the skipper may cancel, postpone, or modify the excursion when weather, sea, technical, or safety conditions do not allow navigation to take place under satisfactory conditions.

The skipper may also modify the itinerary, destination, or duration of the excursion for safety reasons.

In the event of cancellation or postponement, the refund or rebooking arrangements are those provided for in the charter company’s terms and conditions.

6. Security Deposit and Damages

Where a security deposit is required, its amount, payment method, and refund conditions are determined by the charter company and communicated to the customer before the excursion.

The customer may be held liable for damage, loss, or deterioration caused to the boat or its equipment by themselves or by any persons participating in the excursion, in accordance with the rental agreement.

The security deposit may only be retained in accordance with the applicable terms and for amounts for which the customer is contractually liable.

7. Number of Passengers

The maximum number of passengers is determined according to the selected boat and the rules applicable to its operation.

The number of passengers stated at the time of booking must be accurate.

No additional person may board without the prior agreement of the charter company and the skipper.

8. Obligations of the Skipper and Passengers

The skipper is responsible for navigation and safety on board.

All passengers must comply with the skipper’s instructions.

Passengers must:

  • comply with safety instructions;
  • respect the boat and its equipment;
  • behave in a manner that does not endanger other persons on board;
  • comply with the scheduled meeting time and location;
  • immediately report any incident to the skipper.

The skipper may refuse boarding or discontinue an activity whenever they consider that a situation poses a safety risk.

9. Late Arrival and Failure to Attend the Departure

The customer must arrive at the time and location specified at the time of booking.

A delay may result in a reduction in the duration of the excursion and does not automatically entitle the customer to an extension.

In the event of a significant delay or failure to attend, the excursion may be treated as a “no-show” in accordance with the charter company’s terms and conditions, without a refund where such terms provide for this.

10. Insurance

The boat and its operation are covered by insurance policies taken out by the charter company, subject to the coverage, limits, and exclusions of those policies.

Such insurance does not necessarily cover personal belongings, medical expenses, cancellation, personal accidents, or other expenses incurred by the customer.

The customer may, if they wish, take out personal insurance or additional travel insurance.

For precise information regarding the coverage applicable to the selected boat, the customer may request such information from the charter company before the excursion.

11. Liability of Beauty Charters

Beauty Charters acts as an intermediary and does not directly control the navigation, boat, skipper, weather conditions, or the actual performance of the excursion.

Beauty Charters therefore cannot be held liable for decisions made by the skipper, breakdowns or damage, navigation conditions, changes to the itinerary, or cancellations decided by the charter company, except where liability is directly attributable to Beauty Charters or where such liability cannot legally be excluded.

For any issue concerning the boat or the performance of the excursion, the customer should first contact the relevant charter company.

Beauty Charters may facilitate communication between the parties where necessary.

12. Complaints and Disputes

Any complaint must be addressed as soon as possible to the relevant party.

Disputes relating to the rental or performance of the nautical service shall primarily be governed by the contract entered into with the charter company.

These terms and conditions are governed by the law applicable in Saint-Martin, subject to any mandatory provisions applicable to consumers.

Where the applicable legal requirements are met, the consumer may refer the matter to the consumer mediation scheme applicable to the relevant professional.

13. Acceptance

By confirming a booking, the customer acknowledges having been informed that:

  • Beauty Charters acts as an intermediary;
  • the nautical service is performed by the selected charter company;
  • the charter company’s contract constitutes the reference document governing the rental and use of the boat;
  • they may request to review the service provider’s rental terms before the excursion and, if they wish, before paying the deposit;
  • the price offered by Beauty Charters is identical to the price offered by the charter company for the relevant service;
  • Beauty Charters may be remunerated by a commission paid by the charter company, at no additional cost to the customer.
